Iraqis Cheer And Fear - U.S. Pulls Out From Cities

Tuesday marked the deadline for American troops to pull out of Iraq’s towns and cities — a long-anticipated date that has been met by street festivals in Baghdad.

Celebrations were tempered, however, by fears of renewed violence as insurgents seek to use the date to stage new attacks.

At least 30 people, including women and children, were killed and 45 wounded Tuesday in a bombing in northern Iraq, a local police official said.

The blast took place in a busy commercial area in a predominantly Kurdish part of Kirkuk, destroying 20 shops and houses, the official said. Kirkuk is about 235 miles north of Baghdad.

To mark the the U.S. pullback, newscasters on state TV network Al-Iraqiya draped Iraqi flags around their necks as an on-screen clock counted down to midnight Monday (5 p.m. ET). Earlier Monday evening, hundreds of people danced and sang in a central Baghdad park.

“I feel the same way as any Iraqi feels — I will feel my freedom and liberation when I don’t see an American stopping an Iraqi on the street,” said Awatef Jwad of Baghdad.

There were no columns of tanks rolling out of Baghdad or thousands of troops marching out of other cities as the deadline approached. The U.S. military gradually has been pulling its combat forces out of Iraq’s population centers for months, and they already were gone by the weekend, Pentagon spokesman Geoff Morrell told reporters in Washington.

But Iraqi Prime Minister Nuri al-Maliki and other Iraqi and U.S. officials had warned of an increase in attacks around the withdrawal date as insurgents attempt to re-ignite the sectarian warfare that ravaged the country in 2006 and 2007.

While many Iraqis publicly said they are glad to see Americans out of their neighborhoods, some cited worries about what the future may hold without the U.S. military nearby.

“Without the Americans, we were afraid of each other,” said Hanaa Abdul Hassan of Baghdad.

“And now that the Americans are leaving, we will be more afraid. We knew the Americans were holding them back, so now I don’t know what’s going to happen,” she said, without specifying who “they” were.

In the past 10 days, a series of spectacular attacks — including bombings that have targeted civilians — have killed more than 200 Iraqis.

In addition to Tuesday’s deadly blast in Kirkuk, a car bombing Monday in Mosul killed at least nine Iraqi police officers. Iraqi Vice President Tariq al-Hashimi, a Sunni, urged people to avoid crowded public gatherings unless necessary.

But the top U.S. general in Iraq insisted Tuesday that much of the country was safe.

“There is not widespread violence in Iraq,” Gen. Ray Odierno told reporters in a videoconference from Baghdad.

“There’s still gonna be bumps in the road. There’s still gonna be violence here,” Odierno said.

U.S. officials said they believe Iraq’s police and army can keep a lid on the violence, which Morrell said was at the lowest point “in the history of this conflict.”

Madoff Senteced To 150 Years!

Inside a U.S. District Court in Manhattan on Monday morning, a judge sentenced the former Wall Street bigwig to 150 years behind bars for his crimes, the maximum possible sentence.

The courtroom erupted into a chorus of loud cheering and applause after the sentence was read.

In one of the most anticipated rulings this year, U.S. Judge Denny Chin decided upon the sentence after hearing the requests for no mercy from prosecutors and many of the victims whom the 71-year-old Madoff wiped out.

Chin spoke for about five minutes, calling the fraud “staggering” and noted that it spanned more than 20 years. He said “the breach of trust was massive” and said that any sentence above 15 or 20 years would be symbolic.

“I am deeply sorry,” Chin told the victims.

Madoff, wearing a dark suit, white shirt and a tie, sat and listened as emotional witnesses described how he spoiled their security, and they urged Chin to send him to prison for life.

“Life has been a living hell. It feels like the nightmare we can’t wake from,” said Carla Hirshhorn.

“He stole from the rich. He stole from the poor. He stole from the in between. He had no values,” said Tom Fitzmaurice. “He cheated his victims out of their money so he and his wife Ruth could live a life of luxury beyond belief.”

Dominic Ambrosino called it an “indescribably heinous crime” and urged a long prison sentence so “will know he is imprisoned in much the same way he imprisoned us and others.”

He added: “In a sense, I would like somebody in the court today to tell me how long is my sentence.”

One woman talked about how she’s been forced to begin collecting cans and turning them in for deposit money.

Afterwards, Madoff spoke and apologized to his family and to the victims, saying “I dug myself deeper into a hole” as the scheme progressed and that he made an “error in judgment … I could not accept that for once in my life, I failed,” he said.

“Saying I’m sorry is not enough I will live with this pain, this torment, for the rest of my life,” he added. Then Madoff turned to face his victims and said: “I turn to face you, I know this will not help. I’m sorry.”

In his ruling, though, Chin said he didn’t believe Madoff was sincere in his apology. He also said he knew that any sentence he gave would not bring back the money the victims lost in the scheme, but he hoped that it would bring some bit of healing.

While a vast segment of Madoff’s victims wrote to Chin to tell of the ruin that’s become their lives, the judge said not one member of Madoff’s family wrote him to say why Madoff should receive leniency.

It’s estimated that Madoff crushed the financial security of about 8,000 victims. The former NASDAQ chairman bilked his investors of what’s been figured to be $65 billion, the largest Ponzi scheme ever. He pleaded guilty to 11 criminal counts, including charges of securities fraud, investment advisor fraud, mail fraud, wire fraud, money laundering, false statements, perjury, making false filings with the SEC, and theft from an employee benefit plan.

For some who’ve lost everything, it’s no longer about the man who cheated them.

“I don’t care. We don’t care what happens to Madoff. We’d just like to get our money back,” victim Lawrence Cohen said in a recent interview.

Madoff’s attorney, Ira Sorkin, had sent Chin a letter requesting the sentence to be a mere 12 years, calling that a “humane” punishment.

“Mr. Madoff is currently 71 years old and has an approximate life expectancy of 13 years,” wrote Sorkin. “A prison term of 12 years — just short of an effective life sentence — will sufficiently address the goals of deterrence, protecting the public and promoting respect for the law.”

That notion sickened those who suffered at the hands of Madoff.

“I would like to see him get a lifetime imprisonment, and not in one of the fancy country club jails,” victim Rose Less says.

Rose and Jack Less claimed they’re out $800,000 because of Madoff. What made their case more heartbreaking is the Securities Investor Protection Corporation will hand out money to other Madoff victims, but not to them. The SIPC has a formula that excludes the Less’ because they withdrew money over the years.

“They were victimized obviously by Madoff, and now seemingly they are victimized again by the SIPC trustee, and essentially the SEC too,” Less family attorney Barry Lax says.

“We started to sell our furniture, some of our things that we value, so we should have some money immediately,” Rose says.

On Friday, a federal judge ordered Madoff to forfeit $170 billion in assets. His wife, Ruth, must also give up $80 million of her assets, including her Manhattan penthouse, but that still leaves her with $2.5 million.

Madoff was arrested in December and spent several months on house arrest before he was ordered to the Metropolitan Correctional Center in Manhattan. At the time of Madoff’s arrest, fictitious account statements showed thousands of clients had $65 billion. But investigators say he never traded securities, and instead used money from new investors to pay returns to existing clients.

Prosecutors said Friday that the total losses, which span decades, haven’t been calculated. But 1,341 accounts opened since December 1995 alone suffered loses of $13.2 billion, they said.

Judge Orders Full Senate To Meet Tomorrow


A judge ordered the full Senate to convene in Albany tomorrow morning, a possible first step to ending the three-week circus upstate.

Judge Joseph Teresi also ruled the Assembly back to session to pass companion legislation if necessary.

Teresi said failure to come together would be “rude, inconsiderate and egotistical.”

Gov. David Paterson has been trying to force the Democrats and a Republican-led coalition to pass bonding, taxing and other measures set to expire shortly. He says neither faction alone can seat a quorum needed to act. Both sides have been answering Paterson’s order by meeting separately and conducting no official business since the governor called for the first special session a week ago. The factions are deadlocked 31-31 in a dispute over which has majority control. Negotiations over sharing power have failed so far.

Before Teresi ruled this afternoon, two other state judges had declined to intervene in the dispute. Asked to determine which group rightfully elected the Senate’s presiding officer, both said that under the state constitution, it’s up to the senators to sort out their own affairs.

Swastika Painted On Historic Bialystoker Shul

Police are investigating after a swastika was found yesterday painted on the inside of a Manhattan synagogue.



A swastika and a derogatory word were painted on an inside door of the Bialystoker Shul on Bialystoker Place / Willet Street. A smoke bomb was set off, as well.



State Assembly Speaker Sheldon Silver has attended the synagogue since he was a child and said he was furious to discover what had happened.



“This is a crime, not against the synagogue; this is a crime against society,” said the assemblyman. “When people choose to desecrate a house of worship, it doesn’t matter whether it’s a church, a synagogue. It is just a despicable act that really should tug at the heartstrings of all of us.”



Silver said surveillance cameras nearby may have caught the perpetrators.

Cops Friday arrested two teens who have been terrorizing Jewish residents and sites on the lower East Side with eggs, smoke bombs and swastikas.



The youngsters kicked off the anti-Semitic spree at 1 p.m. Thursday when, armed with a magic marker and a smoke bomb, they scrawled a swastika on a wall at the United Hebrew Center on East Broadway, police said. They set off the smoke device, too, before bolting.



An hour later at the Bialystoker Synagogue, the teens drew another swastika and wrote the slur "k---" on a wall. They later hurled eggs at the house of worship, cops said.



The kids - a 15-year-old Asian male and a 16-year-old black male - were charged with aggravated harassment, criminal mischief and reckless endangerment, all as hate crimes.



"This is a desecration of God, no matter what your religion," said Assembly Speaker Sheldon Silver, who has attended the Willet St. synagogue since he was 4 years old.

Dems Enter Senate Chamber Ahead Of Special Session

Democratic state senators have entered the Senate chambers in Albany for the first time in two weeks, ahead of a special legislative session called by Governor Paterson today.



Paterson is ordering the state Senate to convene for a special session at 3 p.m. to try to break the leadership stalemate that’s paralyzed the chamber.



Democratic State Senator Andrea Stewart-Cousins of Westchester is presiding over the 14 Democratic senators in the chamber.



Republicans, led by Senators Dean Skelos and Pedro Espada Jr., had planned to call their own session at 2 p.m. session in an attempt to grab control of the chamber and the gavel before Democrats arrive for the governor’s session.



There is word that legislators worked through the night to hammer out a resolution to the power stalemate, but Espada said no deal was reached.



The regular session ended Monday with no resolution to the power struggle that began June 8, when Senators Espada and Hiram Monserrate voted with the GOP to oust the Democratic leadership. Monserrate has since gone back to the Democrats, creating a deadlock.



The governor refused a request by state senators to delay today’s special session so they could keep working on a power-sharing deal.



Even though senators are required to attend the special session, the governor cannot force them to vote.

Supreme Court Judge Will Not Rule On Senate Leadership

The following is your daily dose of comedy from our elected officials; NY1 reports:



A State Supreme Court judge said earlier today that he will not rule on whether the Senate was in active session last week when Republicans and two dissident Democrats staged a power grab, saying it’s improper for the court to get involved in the matter.



At a hearing this afternoon in Albany, State Supreme Court Justice Thomas McNamara dismissed the case and told the Legislature to resolve the issue of leadership.



“I’ll be honest with you,” said McNamara earlier today, “coming out here today and going through this ritual is not something that I’m really getting enjoyment out of.”



A closed-door meeting yesterday failed to produce an agreement on who is in charge of the New York State Senate.



Governor David Paterson says he will step into the Senate chamber and run the session as he did when he was lieutenant governor, thus eliminating the problem of having no one to gavel in the session. He says this temporary move will allow both parties to enter the chamber and pass essential bills.



Several dozens of protesters are outside the state Capitol today, criticizing the inactions of the state government.



The Senate is currently divided at 31 Democrats and 31 Republicans after State Senator Hiram Monserrate rejoined the Democrats yesterday.



That move came one week after Monserrate and fellow Democrat Pedro Espada Junior voted with Republicans, giving the GOP a majority.



Democrats say they offered Republicans several perks at yesterday’s meeting, including alternating leadership on certain days and a bi-partisan review process for bills before they come to the floor.



But Republicans are dismissing those offers, saying last week’s vote to put them in charge was valid. Democrats want the judge to rule that the State Senate was not in an active session for that vote.



Senator Malcolm Smith is insisting that he still retains the title of majority leader. But Monserrate only agreed to rejoin the Democratic conference on a key demand – that Smith, in essence, be replaced as head of the party.



Senator John Sampson of Brooklyn was given the title of leader of the Democratic conference.



“We had a vote, we voted for John Sampson to be our leader for day-to-day business,” said Smith. “As you know, any business or corporate structure where you have a chairman, you have a CEO. You can look at John Sampson as the CEO.”



Meanwhile, in a separate legal action, Democrats are seeking to hold the self-proclaimed temporary president of the Senate, Pedro Espada Junior, in contempt of court for holding a short session yesterday.



Senator Pedro Espada Junior remains defiant, saying the Republicans are in charge of the State Senate.



During a rally outside the Capitol, Espada called himself the president of the Senate and said Senator Dean Skelos is the majority leader.



Espada insists last week’s vote is binding, despite Monserrate’s decision to flip back to the Democrats.

Judge Temporarily Blocks Senate Takeover

An appeals judge issued a temporary restraining order to prevent a new coalition from taking control of the New York Senate at least until Friday afternoon.

The ruling late Thursday afternoon by Appellate Division Justice Karen Peters blocks Sen. Pedro Espada, one of the dissident Democrats, from acting as Senate president. A five-judge panel is scheduled to consider arguments Friday afternoon on whether to let that stand.



Meanwhile, attorneys are set to argue Friday morning before State Supreme Court Justice Thomas McNamara in Albany on who legally is in charge.



The move comes hours after chaos and political theater resumed in Albany late Thursday morning. Angry protests and even pushing and shoving broke out as the coalition government took over the Senate chamber.



The Senate coup may have been bloodless when it happened on Monday, but the first attempt to open the Senate chambers on Thursday was ugly, dangerous, and unprecedented. Albany has never seen such chaos, such out and out disrespect for elected officials. Republican leader Dean Skelos and Democrat Pedro Espada were set upon by demonstrators who shouted “Senate not for sale!” as they filled the hallways when the locked Senate chamber doors were.



Other senators had to run a gauntlet of pushing, shoving, and screaming protesters. One senator was knocked down and another got spit in the face.



Once inside, the 32 members of the bipartisan coalition had a number of surprises. Democrats had locked up the bills, so there was nothing to vote on. And one renegade Democrat, Sen. Hiram Monserrate, appeared to be wavering in support of the coup. He and Espada were the only Democrats on the floor as the rest boycotted after state Justice George Ceresia refused the Democrats’ request to stop the coalition from opening the Senate and running its first session.



“I think it’s unfortunate how this discourse has really degenerated into what it has become,” Monserrate said during the session. “For us to be an effective bipartisan body, we need cooperation from both sides. These chambers must not remain divided.”



That left open the possibility that Monserrate would leave the coalition.



“My understanding and agreement to coalition government was under certain criteria. Those criterion included reform, reforms that we have laid out in a very appropriate manner that deal with decades and decades of dysfunction and unfairness in this house,” he said.



One Democratic power broker told CBS 2 that efforts to bring Espada back into the fold were also underway, but right after the session, Espada seemed to be standing firm.



“Now the ball is on court, the Democrats’ court, the Democratic conference court. They must show up to work or really have a lot to say to the citizens of the state that want their senators back at work,” he said.



Espada hinted at a coalition strategy for getting Democrats back in their seats – putting bills they care about like same-sex marriage on the agenda for a vote.



“I want to put on the active list a progressive agenda that’s been deferred for too long like same-gender marriage, put that on the floor and then have the Senators that either sponsored it before or defenders of the cause and [if they don’t] show up, I think that would be the height of irresponsibility,” he said.



Now comes the political pressure.



“Arm twisting would be a polite way to put it,” said Blair Hornor of the New York Public Interest Group. “Some of the things that are now probably prohibited by President Obama will be used.”



The Senate is adjourned until Monday, so the big questions is whether coup members stand strong or fall apart under a barrage of arm twisting.

Crude Oil Rises Over 70$, Gas Surges

Crude oil rose above $70 a barrel and gas climbed to an eight-month high while the dollar fell,
bolstering the appeal of energy as an alternative investment.



Oil advanced 2.8 percent as rising stock prices reduced the need for holding the U.S. currency as an inflation hedge. The U.S. Energy Department will probably report tomorrow that refiners boosted operating rates to meet summer gasoline demand, according to a Bloomberg News survey.


Crude oil for July delivery gained $1.92 to $70.01 a barrel at 2:51 p.m. on the New York Mercantile Exchange, the highest settlement since Nov. 4. Prices have risen 57 percent this year.


Gasoline for July delivery rose 3.07 cents, or 1.6 percent, to end the session at $1.9667 a gallon in New York. It was the highest settlement since Oct. 9.


Regular gasoline at the pump, averaged nationwide, will cost $2.47 a gallon from April through September, the Energy Department said today in its monthly Short-Term Energy Outlook. The retail price forecast is down from $3.81 a gallon last summer and up from $2.21 estimated last month.

New York Route 17 Lanes Closing

Motorists are advised that the New York State Department of Transportation will be removing the temporary concrete barrier on Route 17 between exits 122A and 124 in the Town of Goshen later this week. Work will be performed on Thursday, June 11, and Friday, June 12.



The left and middle lanes of the westbound side will be closed on Thursday between exits 123 and 122A from 7 a.m. to 1:30 p.m. to remove the barrier.



The left and middle lane of eastbound will be closed on Friday between exits 122A and 124 from 10 a.m. to 2:30 p.m. to remove the barrier.



Motorists are reminded that fines are doubled for speeding in a work zone. In accordance with the Work Zone Safety Act of 2005, convictions of two or more speeding violations in a work zone could result in the suspension of an individual’s driver’s license.

Supreme Court Nominee Sotomayor Injured At Airport

Supreme Court nominee Sonya Sotomayor, 54, has reportedly broken her ankle after stumbling at LaGuardia Airport in New York. The judge was en route to Capitol Hill on Monday to continue her meetings with the senators.


She started meeting with senators last week, and by the end of the week had met with more than one-quarter of the senate, and most members of the Judicial Committee.


She would replace Souter in the court, if she is confirmed, first got a call from the White House on April 27, had almost daily contact with his office after Souter announced his retirement on May 1.


If confirmed Sotomayor would be the first Hispanic, and the third woman to serve in the court.

More Bodies Recovered From Air France Flight

Seventeen bodies were recovered from last week’s crash of an Air France jetliner off the South American coast, according to Brazil’s military.



The Brazilian navy and air force said they found nine bodies in the Atlantic Ocean, where the Airbus A330-200 went down. The crew of a French ship taking part in the search has found eight, military officials told reporters Sunday evening.



Air France 447 disappeared over the Atlantic early Monday. The jet was en route to Paris, France, from Rio de Janeiro, Brazil, with 228 passengers and crew aboard.



The bodies were found floating about 700 miles from the Brazilian coast. Items found in the same area Saturday were confirmed to have come from the jet, including pieces of the aircraft’s wing section, luggage and a leather briefcase containing an airplane ticket with a reservation code for the doomed flight.



The exact location of the crash has not been determined, since ocean currents likely caused the bodies and debris to drift in the six days since the crash. And two key pieces of evidence — the flight data and cockpit voice recorders — remain missing, and could lay on the ocean floor.



The part of the ocean where the debris and bodies have been found ranges between 19,685 and 26,247 feet deep. The search area covers 77,220 square miles, an area nearly as big as the country of Romania.



Fourteen aircraft — 12 Brazilian and two French — were participating in the recovery efforts, along with five Brazilian ships and one French frigate. In Washington, a U.S. defense official told CNN the U.S. Navy will contribute two high-tech acoustic devices to listen for emergency beacons still operating in deep water.



The “towed pinger locators” help search for emergency beacons on downed aircraft to a maximum depth of 20,000 feet, and will be placed aboard two French tugs that are part of the search efforts, the official said.



Recovery of bodies and debris is significant not only for families, but for crash investigators, said Mary Schiavo, a former inspector general for the U.S. Department of Transportation.



“Even if they don’t find anything else they can get some very important clues from the pieces that they do find and from the human remains,” Schiavo told CNN.



She said investigators would be able to discern if there was an explosion from possible residue on the bodies or other items. Or, if water is found in the lungs of victims, investigators would know the plane went down intact, she said.

A new civilian watch group in Crown Heights is bringing together blacks and Jews in a neighborhood once synonymous with racial tension.



If all goes as planned, a Caribbean-American pastor could share a car with an Orthodox Jew on the NYPD Civilian Observation Patrol - or blacks might volunteer for Friday night shifts, when their Jewish neighbors can’t work.



“It’s a quantum leap beyond what it was in 1991,” Police Commissioner Raymond Kelly said, referring to the riots that rocked the community nearly two decades ago.



About 50 residents have signed up for the police-sponsored group, completing 60 hours of training before they got black jackets, ID cards and hybrid cars with NYPD emblems.



“You are now officially the eyes and ears of the department,” Kelly told them in a dedication ceremony outside the 71st Precinct.



There already are Jewish patrols in the area, Shomrim and Shmira. In the past, there’s been friction between the two - and with the black community.



Members of the Shomrim and Shmira groups said they welcome the NYPD-backed patrol in the neighborhood.



But while several Shmira volunteers have joined, Shomrim members have shunned it so far.



Shmira member Levi Huebner, 40, signed up and said the NYPD is “giving us resources and training to do the job properly.”



“Ideally, we’ll have one patrol that incorporates everybody,” Kelly said.

Bodies and Debris recovered From Air France Flight

Brazilian search crews on Saturday retrieved the first bodies from a crashed Air France flight in the Atlantic, and investigators said faulty speed readings had been found on the same type of jets.


Navy ships found the bodies of two men and debris including a blue seat with a serial number matching Air France Flight 447, a rucksack containing a vaccination card, and a briefcase with an Air France ticket inside, rescue officials said.


"This morning at 8:14 a.m., we confirmed the rescue from the water of pieces and bodies that belonged to the Air France flight," air force spokesman Jorge Amaral told reporters in the northeastern Brazilian city of Recife.


Brazilian air force planes and navy ships have been scouring a swathe of the Atlantic about 1,100 km (683 miles) northeast of Brazil's coast since the Airbus A330-200 plane disappeared on Monday, killing all 228 people on board.



The crash of the flight from Rio de Janeiro to Paris was the world's deadliest air disaster since 2001 and the worst in Air France's 75-year history.


Rescuers, who said that only family members will be informed of the identity of the corpses, believe many bodies could have sunk or been devoured by sharks.
Searchers previously had retrieved debris from the ocean that turned out to be unrelated to the crash.


French investigators trying to establish the cause of the crash said on Saturday that Airbus had detected faulty speed readings on its A330 jets before last week and had recommended that clients replace a sensor.

AIR FRANCE CHANGING SENSORS


Air France later issued a statement saying it had begun changing airspeed sensors on Airbus long-haul aircraft due to icing fears five weeks before the crash, but only after failing to agree on a fix with Airbus.


Investigators are considering the possibility that the speed sensors on Flight 447 may have iced up, resulting in faulty readings that caused the pilots to set the plane at a dangerous speed as it passed thunderstorms.


But the head of France's air accident agency (BEA) said in a news conference in France that it was too soon to say if problems with the pressure-based speed sensors were in any way responsible for the disaster.


"Some of the sensors (on the A330) were earmarked to be changed ... but that does not mean that without these replacement parts, the (Air France) plane would have been defective," BEA chief Paul-Louis Arslanian said.
Brazil navy looking for debris


Airbus confirmed it issued a bulletin asking the plane's 50 or so airline operators to consider changing the speed sensors, known as Pitot tubes, but it said it was an optional measure to improve performance and not related to safety.


In its statement on Saturday, Air France said it began noticing airspeed problems from icing on both A330 and A340 planes in May 2008 and had requested a solution from Airbus.
According to Air France, Airbus proposed testing different sensors despite earlier doubting that they would resolve the problem, but the airline declined to wait and started changing them from April 27. Airbus was not immediately available to comment.

FLURRY OF MESSAGES


The doomed Air France plane sent 24 automated messages in a span of four minutes indicating a series of system failures before it vanished, Arslanian said.


In the middle of this stream of data was one message showing inconsistent speed readings from the A330's sensors, investigators said.


The messages also showed that the autopilot was off, though it was impossible to say whether it had disengaged itself, as it is designed to do when it receives suspect data, or whether the pilot had decided to turn it off, Arslanian said.


Airbus issued a reminder on Thursday that pilots should follow standard procedures -- to maintain flight speed and angle -- if they thought their speed indicators were faulty.
Meteorological experts said the jet crossed a storm zone but that the weather did not seem to pose a particular threat.


Investigators have said they are not optimistic that they will be able to locate the plane's flight recorders, which could provide vital information about the cause of the crash.


The search zone is a relatively uncharted patch of ocean that has deep ravines and a fine, muddy sediment.


France is sending a nuclear-powered submarine to try to locate the two flight recorders, which could be at a depth of anywhere between 2,835 and 13,120 feet, said Laurent Kerleguer, the French navy's deputy head of hydrography.

Reports Show Air France Pilot Battled 15 Minutes To Save Flight

Details have emerged of the moments leading up to the disappearance of flight AF 447 with 228 people on-board, with error messages reportedly suggesting the plane was flying too slowly and that two key computers malfunctioned.



Flight data messages provided by an Air France source show the precise chronology of events of flight AF 447 before it plummeted into the sea 400 miles off Brazil on Monday.



These indicate that the pilot reported hitting tropical turbulence at 3am (BST), shortly before reaching Senegalese airspace. It said the plane had passed through tall, dense cumulonimbus thunderclouds.



At this point, according to a source close to the investigation cited by Le Monde, the Airbus A330-200's speed was "erroneous" - either too fast or too slow. Each plane has an optimal speed when passing through difficult weather conditions, which for reasons which are unknown, had not been reached by flight AF 447.



Airbus is expected to issue recommendations today to all operators of the A330 model to maintain appropriate thrust levels to steady the plane's flight path during storms.



At 3.10am, the messages show the pilot was presented with a series of major failures over a four-minute period before catastrophe struck, according to automatic data signals cited by the Sao Paulo newspaper, le Jornal da Tarde.



At this time, the automatic pilot was disconnected – either by the pilot or by the plane's inbuilt security system, which flips to manual after detecting a serious error.



It is unclear whether the pilot wanted to manually change course to avoid a dangerous cloud zone – an extremely difficult manoeuvre at such high altitude.



At the same moment, another message indicates that the "fly-by-wire" electronic flight system which controls the wing and tail flaps shifted to "alternative law" – an emergency backup system engaged after multiple electricity failures. This system enables the plane to continue functioning on minimum energy but reduces flight stability. An alarm would have sounded to alert the cabin crew to this.



Two minutes later, another message indicates that two essential computers providing vital information on altitude, speed and flight direction ceased functioning correctly.



Two new messages at 3.13am report electricity breakdowns in the principal and auxiliary flight computers.



At 3.14am, a final message reads "cabin in vertical speed", suggesting a sudden loss of cabin pressure, either the cause or the consequence of the plane breaking up in mid-air.



Despite the precise details, sources close to the investigation contested the chronology and denied that the two computers providing altitude, speed and directional data malfunctioned.



The suggestion that the pilot gradually lost control of the plane appears to counter reports that the plane exploded in mid-air.



These were lent more weight today after a Spanish pilot in the vicinity at the time reported seeing an "intense white flash".



"Suddenly we saw in the distance a strong and intense flash of white light, followed by a downward, vertical trajectory which broke up into six segments," the chief pilot of an Air Comet plane from Lima to Madrid told the Spanish newspaper, El Mundo. He has reported his observations to investigators.



Some experts have supported the theory that the plane exploded, given the wide area where debris has been found.



However, Brazil's defence minister, Nelson Jobim, said an explosion was "improbable" given the 13-mile trail of kerosine spotted on the sea. "If we have fuel slicks, it's because it didn't burn," he said.



Paul-Louis Arslanian, the head of the French air accident bureau in charge of the investigation, also said there were other possible reasons for wide debris area, such as high winds and choppy seas.



Yesterday he warned against hasty "speculation" and said that the search would take time.



Four naval vessels and a tanker are in the area around 400 miles off Brazil's northeastern coast. Some 11 spotter planes are searching for more debris, after finding a seat and a 23-foot metal object thought to be part of the fuselage. A French mini-submarine will arrive in the zone next week.

Synagogue Terror Suspects' Dad Rips Jews

Terror suspect David Williams’ father went on an anti-Semitic rant after his son and three others entered not guilty pleas.



“The government is blowing this up, especially those Jews,” David Williams Sr. said of allegations the four suspects plotted to blow up Bronx synagogues.



“Those Jews in the media are turning this into something it is not.”



The younger Williams and co-defendants Laguerre Payen, James Cromitie and Onta Williams pleaded not guilty to a federal indictment that accuses them of conspiring to use weapons of mass destruction. If guilty, they could face life in prison.



Payen tried to portray himself as mentally unfit to stand trial. “I don’t understand the stuff the court talks about,” he said in White Plains Federal Court.



Federal prosecutor Eric Snyder said it was a crazy act.



“On April 28, he is on a very clear recording talking about beating the case in a very sophisticated way,” Snyder said. “It’s very different from the way he’s talking now in an effort to mislead the court.”

Carter Will Try To Help Free Gilad Shalit

Former American President Jimmy Carter, who will oversee the upcoming Lebanese elections, is expected to meet next week with President Shimon Peres in an effort to release Gilad Shalit.



The former American president last year intervened and arranged for a letter form his son to be delivered to his parents via Hamas leader Khaled Meshal.



In a related matter, the soldier’s parents, Noam and Aviva Shalit, met on Wednesday with Prime Minister Binyamin Netanyahu. They also met with Ofir Dekel’s replacement, Chaggai Hadas, who is not responsible for representing Israel in talks with Hamas towards obtaining Gilad’s release.

Swine Flu Shuts The Doors Of Four Jewish Brooklyn Schools

Four Jewish schools in Brooklyn have been forced to shut their doors, because of Swine Flu. They are Magen David Yeshiva, Yeshivas Chofetz Chaim (Brooklyn), Masores Beis Yaakov, and Sharei Torah (all divisions). Chofetz Chaim has reopened on Tuesday (5/26/09). Bais Yaakov Of Boro Park is closed. Bobover Cheder in Monsey has been closed as well. They will all be closed until after Shavuos, due to Swine Flu.

Congress Approves Credit Card Industry Restriction Bill

Congress on Wednesday sent to President Obama a bill that makes it tougher for credit card issuers to raise fees and interest rates.



The move caps a years-long crusade by consumer groups and Democrats to rein in what they say are abusive practices that prey on consumers. The approval came despite strong objections by banking industry advocates, who say it could result in tightened credit to Americans.



The House voted 361-64 in favor and also approved by 279-147 an unrelated measure allowing people to carry guns into national parks.



The Senate passed the credit card bill, along with the unrelated gun measure, by a 90-5 vote on Tuesday.



The bill is expected to be signed by President Obama as soon as Friday.



The credit card rules would take effect in February. The bill is moderately tougher on banks and card issuers than are new Federal Reserve rules set to take effect July 2010.



The legislation make it harder for people under age 21 to get credit cards. It would also ban rate hikes unless a consumer is more than 60 days late - and then restore the previous rate after six months if minimum payments are made.



The bill marks a major loss for the banking industry.



Financial services representatives have decried the bill, saying it would exacerbate the credit crisis and force banks to drop some risky credit card holders. The American Bankers Association said the legislation would prompt banks to reinstate annual fees and higher interest rates for all card holders, an outcome that would penalize those with good credit who pay their bills on time.



In recent months, credit card companies have been raising fees and interest rates. From November 2008 to February 2009, rates increased from an average to 13.08% from 12.02%, according to a Federal Reserve Board report.

Credit Card Bill Passed By Senate


The Senate today overwhelmingly passed a bill that would sharply curtail credit card issuers’ ability to raise interest rates and charge fees, taking a critical step in reforming an industry that has gone largely unregulated for decades.



In a 90-5 vote, The Senate delivered a victory to consumer groups and to the White House, who blame industry practices for sending Americans deeper into debt just as they are losing their jobs and their homes.



Lawmakers will now turn to reconciling differences with a similar bill passed by the House on April 30. President Obama has said he wants to sign a bill into law by Memorial Day.



Consumer advocates said the Senate’s action showed a solid commitment to consumer protection.



“This is landmark legislation that is going to make the credit card marketplace more transparent and more fair for millions of consumers,” said Travis B. Plunkett, legislative director for the Consumer Federation of American. “In particular, it’s going to prevent credit card companies from suddenly and unjustly increasing interest rates which is pushing many consumers with credit card debt into bankruptcy.”



Congress stepped up efforts to pass legislation in recent weeks, as several card companies increased interest rates and cut limits on both delinquent and credit-worthy customers. Outraged consumers complained that they were being mistreated by the same companies that were receiving federal bailout money. The Obama administration listened and stepped into the fray, meeting with credit card executives at the White House and stipulating provisions they wanted to see in legislation.



Industry representatives have argued that any legislation would result in more lost revenue and force them to raise interest rates and withhold credit.



“Credit cards are a strong economic driver and are relied upon by consumers and small businesses to make payments and to bridge short-term financial gaps,” said Edward L. Yingling, president and chief executive of the American Bankers Association. “The goal in the legislation should be to obtain the right balance: providing protections, while maintaining the important role of credit cards in providing loans to consumers and small businesses. Unfortunately, we believe the bill does not achieve that balance and will therefore cause an unnecessary decrease in credit availability.”



Analysts and lawmakers said the chances of a swift compromise were high because the issue has such populist appeal. Even Republicans who had vehemently opposed reform made critical concessions. The House will now either approve the Senate bill or the legislators will have to agree on a version to send to Obama.



The Senate bill allows rate hikes only if the borrowers’ payment was past due 60 days. Card companies would have to restore the original rate if the customer paid on time for the next six months.



The House bill, authored by Rep. Carolyn B. Maloney (D-N.Y.), largely mirrors regulations passed by the Federal Reserve in December that also would ban so-called “unfair and deceptive” practices. It is not considered as strong as the Senate bill.



The Federal Reserve’s new rules do not go into effect until July 2010. Both the House and Senate bills seek to accelerate that timeline. The Senate bill would be enacted nine months after signing and the House bill 12 months after.

Jewish Assistant Principal Becomes 1st Swine Flu Death In New York City

The Queens assistant principal stricken with swine flu succumbed to the deadly virus today, the first person to die in the city from the disease, hospital officials said.

"We were treating him very aggressively," said Flushing Hospital spokesman Ole Pedersen. "Unfortunately, he did expire at 6:17 p.m. this evening."

The sick man, Mitchell Wiener, 55, an assistant principal at IS 238 in Jamaica Estates, first fell ill more than a week ago, but didn't seek help at the hospital until his symptoms became severe early Wednesday morning.

Since that time, he's been in a medically induced coma, on a ventilator.

Just hours before his death, his wife, Bonnie, said there were hopeful signs.

"There's no change," she told The Post earlier today. "He's stabilized. They're just giving him supporting care and hoping the treatment will kick in."

According to Newsday He and his wife were active members of Garden Jewish Center until a few years ago, Rabbi Martin Cooper said. Mitchell Wiener served on the synagogue's board of directors and as treasurer in the late 1990s.

"He has a very warm personality," Cooper said. "He is very well-liked in the congregation."

Lawmakers To Commuters: "Don't Park In Brooklyn"


A proposed law may give only residents who live in certain neighborhoods the right to park there.

But there's a catch.

Our neighborhood is not a parking lot. That's the cry of several lawmakers who have introduced legislation to allow residential permit parking. The bill can be viewed here PDF

"Driving around looking for a parking space is a New York tradition as old as corned beef, but if we can do something to improve it we should and this will," said State Sen. Daniel Squadron, D-Brooklyn.

It's another way of saying if you live here you can park here. If you don't, you're plumb out of luck. Residents would buy permits for a nominal fee -- say $25 to $100 a year.

The downtown Brooklyn communities, because they are the gateway to Manhattan, have become a hub for people coming into our neighborhoods parking their cars and then taking mass transit," said Assemblywoman Joan Millman, D-Brooklyn.

But it's not just Brooklyn. Any neighborhood thatwants to keep its parking for its residents can have such a program. Leslie Lewis said he's beside himself because it's difficult to park near his Boerum Hill home.

"I'm not looking for some guaranteed parking space painted in the street, but I am looking for just a proper chance at it without a commuter taking it away," Lewis said.

But there's an "alternate side of the street" to this parking story.

"Oh no, I don't think that's fair," said Monica Wilson of Jamaica. "These are public streets and the entire public should be able to park on them."

"It really shouldn't be because it's a business area, right," added Gloria Katz of Mill Basin.

Other cities that have the residential parking permit program in effect are Boston, Chicago, Washington, D.C., Los Angeles and Hoboken, N.J.

Councilman David Yassky is sponsoring a home rule message to get the state Legislature to approve the measure.

Hong Kong Supermarket On Manhattans' Lower East Side Collapses After Fire


Hong Kong Supermarket, on Manhattans' Lower East Side caught on fire this past Thursday night, at approximately 7:45 P.M.. Officials warned Thursday night, that the 1 story Supermarket was in grave danger of collapsing. Sure enough this past Friday night, it did. Today a demolition company was seen clearing away the debris.

On Friday morning, fire trucks were still on the scene spraying the building.

It appears that the building next to it had a wall facing the Supermarket which collapsed from the heat. The wall then fell on the Supermarket, causing it to fall down.

GM Sends Shutdown Letters To 1,100 U.S. Dealers


General Motors Corp. is sending termination notices today to 1,100 U.S. dealers with about $2.5 billion in unsold vehicles as the automaker starts shrinking its retail network.

The dealers hold about 120,000 GM vehicles of various brands, said the person, who asked not to be identified. The company scheduled a conference call for reporters with Mark LaNeve, GM’s North American sales chief, at noon New York time.

GM is working to pare U.S. dealers by 42 percent, to 3,600, by the end of next year as it faces a probable bankruptcy by a June 1 government-set deadline. With competition reduced among retail outlets, the remaining dealers each may be able to sell more cars at higher prices, boosting profit, the person said.

GM is hoping for an orderly wind-down of the affected dealers over the next year or so, the person said, which means they will close when their inventories are gone.

The next wave of dealer terminations will take place as some dealers decide whether they wish to remain, leaving the automaker to choose who it wants to keep, the person said.

Chrysler Offers $1,000 Certificates to Existing Customers in Hopes of Boosting Sales


Chrysler LLC is preparing to send all existing customers certificates good for $1,000 toward the purchase of new vehicles between now and the end of June, a person briefed on the program said.

The certificates will be mailed along with copies of a letter from Chief Executive Robert Nardelli, Chrysler officials told dealers in a web cast, this person said.

The certificates are meant to boost Chrysler’s sales as it reorganizes under bankruptcy protection, and to help some of the 789 dealers Chrysler plans to drop from its retail network. The auto maker announced the reduction in its dealer body on Thursday. The dealers to be eliminated will be dropped by around June 9, if the plan is approved by the U.S. Bankruptcy Court in Manhattan. Those dealers have to either sell their inventory of new vehicles to customers or to surviving dealers.

The certificates will be sent to more than nine million owners of Chrysler vehicles and can be used toward the purchase of any Chrysler models, the person briefed on the matter said.

NYPD Defends Latest Stop-And-Frisk Report


NY1 Reports: The NYPD defended a report Tuesday that shows a record number of New Yorkers whom are being questioned and frisked this year.

The New York Civil Liberties Union released the report of police data, which shows more than 170,000 people were stopped in the first three months of the year.

The police department is required to keep track of the number of Stop-and-Frisk reports.

The NYCLU says about 90 percent of those stopped were innocent and let go. The group also says the program unfairly targets minorities.

“What we have is an incredible racial disparity in who, in New York, has to worry about walking down the street and getting stopped for doing absolutely nothing wrong, by the police,” said Donna Lieberman of the New York City Civil Liberties Union.

“Stop and frisks have been going up for the past three years and the reason is because they work,” said City Councilman Peter Vallone, Jr. “They are a large part of the reason that crime continues to go down despite the fact that we have 5,000 less officers than we did in 2001. They are the only way, one of the only ways to stop crimes before they happen.”

The NYPD says the racial breakdown matches up to descriptions given by crime victims.

The department claims the high number of officers makes it easier for them to observe possible criminal activity.

The NYPD says they make about 400,000 arrests each year, so the quarterly number in the report is reasonable.

MTA Tolls, Bus Fares, And Subway To Go Up On June 28


Mark your calendars: The price of a single bus or subway ride in New York City is going up by a quarter on June 28 to $2.25.

Fares for the Long Island Rail Road and Metro-North Railroad will be increasing by about 10 percent on June 17. And tolls on the Metropolitan Transportation Authority bridges and tunnels will rise on July 12.

The MTA board authorized the fare and toll hikes Monday after the state Legislature passed a rescue package last week that included higher fees and a payroll tax for employers in New York City and seven surrounding counties.

Just one day after the bailout was approved by legislators last week, the MTA’s executive director and CEO Elliot Sander resigned.

In fact, I’d say that when it came to Afghanistan, obviously, this Obama administration has put more resources into the fight against terrorism than had previously been the case,” Lieberman added in an interview on MSNBC. “On balance, we remain as safe as we can possibly be in a world in which there is Islamist extremists who want to attack us.”
Appearing Sunday on CBS’s “Face the Nation,” Cheney had said it was his “belief” that the nation is less safe because of changes Obama has made in national security.
“In the future, we’re not going to have the same safeguards we’ve had for the last eight years,” Cheney said.
On Monday, Lieberman said he still disagrees with some of the president’s national security policies but made clear that he believes the new administration is determined to protect the country.
“This administration has done everything it could, even in those areas that I disagree with them,” Lieberman said.

NY Senate Dems Considering Medical Marijuana

The movement to legalize medicinal marijuana is gaining momentum in New York, with a proposal to let some people grow their own or buy from a state-approved organization.

Sen. Thomas Duane of New York City is introducing the bill, which will have a matching version sponsored by Manhattan Assemblyman Richard Gottfried. The Democrat-led Assembly has passed similar measures in recent years, but the issue fizzled in the formerly Republican-led Senate.

Now Democrats have taken control the Senate and the issue could get some traction in that chamber. A spokesman for Senate Majority Leader Malcolm Smith didn’t immediately comment.

Gov. David Paterson’s office also did not comment on the proposal Duane is set to release Tuesday.

Red Sarachek Tournament


The Red Sarachek Tournament was a great success, ending with a game between the Ramaz Rams, and the MTA Lions. The game was a blowout, with Ramaz defeating MTA 48-26. We look forward to another well coordinated tournament, and the same (if not more) level of אחדות (achdus) next year.
